1 Article 1. Purpose

The purpose of these Terms of Service is to set forth the rights, obligations, responsibilities, and other necessary matters between thenovary (hereinafter "Operator") and users in connection with the use of the mobile application "NookDex" and related services (hereinafter "Service") provided by the Operator.

2 Article 2. Definitions

1. "Service" refers to the Animal Crossing: New Horizons information and companion mobile app service provided by the Operator, including villager/item/critter compendium browsing, collection tracking, profile and passport card creation, favorite villager tournaments, image saving, ad removal, and premium features. 2. "User" refers to any person who agrees to these Terms and installs or uses the Service. 3. "Paid Service" refers to in-app purchase products available within the Service through an app marketplace, such as ad removal, premium theme unlocks, all-in-one premium, and supporter items. 4. "App Marketplace" refers to third-party platforms through which the Operator distributes the Service or provides payment for Paid Services, such as Apple App Store and Google Play.

3 Article 3. Effect and Amendment of Terms

1. These Terms take effect upon being posted within the Service, on an app marketplace page, or on a separately linked screen. 2. The Operator may amend these Terms to the extent permitted by applicable laws and regulations. 3. When amending these Terms, the Operator will specify the effective date and reason for the change and provide notice within the Service or through a relevant information screen prior to the effective date. 4. If a User continues to use the Service after the effective date of the amended Terms, the User shall be deemed to have agreed to the amended Terms. However, where changes are unfavorable to users, the procedures prescribed by applicable law shall apply.

4 Article 4. Nature and Content of the Service

1. The Service is a fan-based companion app focused on information browsing and personal record management, available without account registration. 2. The Service may include the following features: - Browsing game data including villagers, fish, insects, sea creatures, items, and recipes - Managing personal records such as wishlists, current residents, collection status, and collection progress - Entering and displaying user profile information, island details, friend codes, dream addresses, design codes, birthdays, favorite villagers, and profile photos - Generating, previewing, and saving passport card and tournament result images to the device - Multilingual support, theme customization, ad viewing, ad removal, and use of premium features 3. The Service is an unofficial fan app for Animal Crossing: New Horizons and is not affiliated with, endorsed by, or sponsored by Nintendo Co., Ltd. or its affiliates. 4. Game titles, character names, images, trademarks, and other intellectual property included in the Service are owned by their respective rights holders.

5 Article 5. Formation and Use of the Service Agreement

1. The service agreement is formed when a User agrees to these Terms and installs or uses the Service. 2. In principle, the Service is provided 24 hours a day, 365 days a year; however, all or part of the Service may be restricted due to maintenance, app marketplace review, device conditions, network failures, third-party service outages, or similar circumstances. 3. The Operator may update, modify, or suspend all or part of the Service, or change the scope of features provided. 4. Users may terminate use of the Service at any time by uninstalling the app.

6 Article 6. Device-Stored Information and Permission Usage

1. The Service operates primarily through local storage on the user's device rather than through a user account server. 2. To provide smooth functionality, the Service may store the following information on the user's device: - Profile information: name, island name, hemisphere, native fruit, birthday, friend code, dream address, Nook Miles design code, Happy Home Network ID, date seed, favorite villager, and profile photo path - Personal activity data: wishlists, current residents, collection status, collection progress, and tournament progress and results - Preference settings: language, theme, and local cache for verifying purchase status 3. The Service may use the following permissions or device features: - Photo library or image access: for selecting a profile photo and saving generated images - Internet connection: for serving ads, processing app marketplace payments, loading external images, and similar purposes 4. If a User uninstalls the app or switches devices, some or all locally stored data may not be recoverable. The Operator shall not be liable for the loss of local data on the user's device unless caused by the Operator's willful misconduct or gross negligence. 5. Specific details regarding the handling of personal information are governed by the separately published Privacy Policy.

7 Article 7. Advertising and Paid Services

1. The Service is provided free of charge; however, banner ads, interstitial ads, rewarded ads, and other advertisements may appear on certain screens. 2. Certain features may only become available after watching an advertisement or purchasing a Paid Service. For example, some features such as saving a passport image or saving a tournament result image may require watching an ad or purchasing an ad removal product. 3. The types, prices, delivery methods, and tax-inclusiveness of Paid Services are as displayed on each app marketplace, and the Operator may modify these as necessary. 4. In-app purchases are processed through the payment systems provided by app marketplace operators. The Operator does not directly store or manage users' payment method information such as card numbers. 5. Certain non-consumable products may be restored within the scope recognized by the same app marketplace account; however, restorability may vary depending on app marketplace policies and device conditions.

8 Article 8. Cancellation, Refunds, and Purchases by Minors

1. Cancellation, refunds, payment reversal, and error correction for Paid Services are governed by applicable laws and regulations, these Terms, and the policies of each app marketplace operator. 2. If a User has already used or begun receiving the benefits of a purchased digital content item or immediately usable Paid Service, the right to cancel may be restricted under applicable law. 3. Supporter or consumable products may not be eligible for refund after use or delivery has been completed by their nature, except where refunds are permitted by applicable law. 4. If a minor purchases a Paid Service, the consent of a legal guardian is required. Purchases made without such consent may be cancelled to the extent permitted by applicable laws and app marketplace policies.

9 Article 9. User Obligations

1. Users must comply with applicable laws and regulations, these Terms, Service usage guidelines, and app marketplace policies. 2. Users must not engage in any of the following: - Using the Service or app for any unlawful purpose - Copying, modifying, reverse engineering, decompiling, or circumventing security features of the app - Placing excessive load on the Service through automated means or otherwise - Commercially exploiting data, images, screen layouts, or other content within the Service without the rights holder's permission - Fraudulent payments, unauthorized refunds, ad manipulation, or any attempt to do so - Infringing upon the rights, reputation, likeness, personal information, or intellectual property of any third party 3. Users are responsible for the accuracy and legality of information they directly enter or store within the Service.

10 Article 10. Image Saving and External Sharing

1. The Service may allow users to generate passport images or tournament result images by combining user-entered information with in-app elements, and to save these images to their device. 2. If a User posts, sends, or shares a generated image on an external service, the User is solely responsible for the scope of disclosure and any consequences thereof. 3. Users should be aware that generated images may contain potentially sensitive information such as their name, island name, friend code, dream address, birthday, and profile photo, and must verify the intended audience before sharing. 4. The Operator shall not be liable for any disputes or damages arising from information shared externally by users, unless caused by the Operator's willful misconduct or gross negligence.

11 Article 11. Intellectual Property

1. Copyrights, compilation rights, designs, layouts, logos, text, and rights to content created by the Operator in connection with the Service belong to the Operator or the respective legitimate rights holders. 2. Without the Operator's prior written consent, Users may not reproduce, transmit, publish, distribute, broadcast, display, sell, or otherwise commercially exploit — including creating derivative works from — any materials provided through the Service. 3. Rights to original game-related works belong to their respective rights holders, and Users must not use the Service in a manner that infringes upon those rights.

12 Article 12. Service Changes, Suspension, and Data Accuracy

1. The Operator may modify or suspend all or part of the Service as necessary for operational or technical reasons. 2. Game information, images, spawn conditions, timing, localized names, prices, and other data included in the Service are provided for reference purposes only and may differ from actual in-game content. 3. The Operator endeavors to minimize temporary errors caused by data update delays, display differences across devices, external image loading failures, or app marketplace policy changes, but does not guarantee the completeness, currency, or accuracy of all information.

13 Article 13. Limitation of Liability

1. The Operator shall not be liable for any failure to provide the Service due to force majeure events, including natural disasters, war, terrorism, hacking, network failures, device OS issues, or outages of app marketplaces or advertising/payment service providers. 2. The Operator shall not be liable for service disruptions, device malfunctions, app deletions, local data loss, or network issues attributable to the User. 3. The Operator shall not be liable for damages resulting from outages or policy changes of app marketplaces, advertising networks, external image servers, or operating system features provided by third parties, unless caused by the Operator's willful misconduct or gross negligence. 4. With respect to portions of the Service provided free of charge, the Operator may limit its liability to the extent permitted by applicable law.

14 Article 14. Notices to Users

1. The Operator may provide notices to Users through in-app announcements, pop-ups, app marketplace notifications, or other reasonable means. 2. Notices directed at all Users may be substituted by posting within the Service. However, matters that materially affect Users will be communicated separately to the extent practicable.

15 Article 15. Governing Law and Jurisdiction

1. The laws of the Republic of Korea shall apply to the interpretation of these Terms and to any disputes between the Operator and Users. 2. In the event of a dispute arising in connection with these Terms or the use of the Service, the parties shall endeavor to resolve the matter through good-faith negotiation. 3. For disputes that cannot be resolved through negotiation, the court having jurisdiction under applicable law shall serve as the court of exclusive jurisdiction for the first instance.
